Customer Acknowledgment Before Purchase

This acknowledgment sets out the customer's responsibilities when ordering design, printing, or made-to-order manufacturing, and what approving the files and specifications before production begins means.

Completing a purchase, paying a deposit, uploading files, or approving a design is deemed acceptance of this acknowledgment and the policies associated with it.

The customer acknowledges, when dealing with ENJOY STORE, ENJOY WORLD, or Roshan Advertising Agency through their websites, applications, branches, or approved channels, that they have read, understood, and agreed to the terms and policies associated with their order, in accordance with the regulations in force in the Kingdom of Saudi Arabia.

1. Order Approval and the Start of Production

An order is considered final once payment is complete or the agreed deposit is paid and the final specifications are approved. The actual production period begins after:

  • The amount due is received.
  • All required files and information are received.
  • The design or the final mockup is approved by the customer.

Published or communicated production and delivery times are estimates, and they may be affected by technical, operational, or logistical factors or by circumstances beyond anyone's control. An order may be suspended where details are missing, approval is delayed, or there is a suspicion of a legal breach or an infringement of intellectual property rights.

Any modification the customer requests after approval or after production has begun is treated as an additional request, and may incur fees and an extension of the time required.

2. The Customer's Responsibility for the Content and Materials Submitted

The customer bears legal responsibility for everything they send or ask to have designed, printed, or manufactured, including texts, images, logos, trademarks, identities, graphics, clips, and advertising material.

By sending content, the customer confirms that they:
  • Own it or are legally authorized to use it.
  • Have obtained the necessary permissions and approvals.
  • Are not infringing copyright, trademarks, or the rights of any other party.
  • Are not in breach of the applicable laws and regulations.

The entities named act as providers of design, printing, or production based on the customer's materials, and do not carry out legal research or verification of the ownership of every logo, image, or mark. Accepting or fulfilling an order does not constitute confirmation that the content's legal position is sound.

The customer bears any claims, compensation, fines, and financial or legal consequences arising from the materials they provide, and undertakes to indemnify the producing entity, its owners, employees, and representatives for the related damages, expenses, and fees, to the extent permitted by Saudi law.

3. Unacceptable Content

Requesting the design or printing of content that breaches Islamic law, the regulations, public decency, or the printing and publishing regulations is prohibited. This includes:

  • Religious or moral offense, defamation, and invasion of privacy.
  • Hate speech, discrimination, or incitement.
  • Political or media content that breaches the regulations.
  • Protected logos, marks, images, and works used without permission.
  • Any content that could expose the store or others to liability.

The producing entity has the right to refuse any order it considers likely to cause a breach or legal liability.

4. Design Approval and Final Consent

Approving the proof or mockup through any approved channel is deemed binding acceptance of the sizes, colors, texts, image quality, element positions, language, and wording.

Before clicking “Approve”, review the names, numbers, spelling, translation, and sizes carefully; the producing entity is not responsible for errors the customer approved or for poor-quality files the customer provided.

Final colors may differ somewhat from the screen because of differences between display and printing systems and materials.

5. Printing and Technical Production

The customer acknowledges that printing and manufacturing work may involve slight, professionally recognized technical variations in color, size, cutting, folding, material, or finishing. Acceptable variations that do not affect the essential purpose are not considered a production error.

6. Cancellation, Returns, and Exchanges

  • A product designed, printed, or manufactured to order cannot be cancelled or returned once production has begun.
  • The start of production includes design approval, or the start of printing, manufacturing, programming, or production.
  • Reproduction or replacement is carried out where an error or defect caused directly by the producing entity is established, and after a technical assessment.

7. Warranty and Limits of Liability

The warranty, where it applies, is limited to technical or manufacturing errors caused by the producing entity. It does not cover misuse, breakage, storage, incorrect installation, modifications after delivery, or environmental and operating conditions beyond its control.

The producing entity is not liable for indirect or consequential losses or lost profits, and its liability does not exceed the value of the order that is the subject of the claim, to the extent permitted by the applicable regulations. See the Gold Warranty.

8. Rights to Designs

Rights to the creative work and source files prepared by ENJOY STORE or Roshan Agency remain reserved unless there is a written agreement to the contrary. They may not be resold, modified, or published outside the agreed use without consent.

Completed work may be displayed in the portfolio and in marketing materials unless confidentiality or non-publication is agreed in writing before production. For more details, see the Intellectual Property Policy.

9. Final Acknowledgment

By completing a purchase, paying any amount, uploading files, or approving an order, the customer acknowledges that they:

  • Have read and agreed to this acknowledgment and the policies associated with their order.
  • Are responsible for the accuracy of the content and the rights to use the materials they provided.
  • Have reviewed the design and specifications before approval.
  • Have agreed to the production times and to the modification, return, and warranty policies.
  • Undertake to comply with the regulations in force in the Kingdom of Saudi Arabia.
  • Their electronic approval is considered binding consent and acknowledgment under the regulations.
